Personnel Security Hearing (10 CFR Part 710)

On April 14, 2015, an OHA Administrative Judge (AJ) issued a decision in which he concluded that the DOE should grant access authorization to an individual. A DOE Operations Office referred the individual to administrative review citing as security concerns the individual’s dual citizenship, his expressed unwillingness to renounce his foreign citizenship, and his possession and use of a foreign passport after attaining U.S. citizenship. After conducting a hearing, convened at the individual’s request, and evaluating all relevant evidence, the AJ concluded that the individual’s surrendering of his foreign passport, his expression of a willingness to renounce his foreign citizenship at the hearing, his 22 years of residence in the U.S., and other factors indicated that he did not have a preference for a foreign country over the U.S. Therefore, the AJ found that the individual had adequately addressed the DOE’s security concerns and that the DOE should grant the individual a security clearance.  OHA Case No. PSH-15-0002 (Robert B.
