AeroSys: Test Notice (2009)
DOE issued a test notice to AeroSys in regards to compliance with the applicable energy conservation standards of certain products.
After examining AeroSys data, DOE concluded that the AeroSys data were insufficient to confirm whether Aerosys products comply with the applicable energy performance standards. DOE issued this test notice to AeroSys, Inc., requiring the company to provide sample units for laboratory testing to determine the compliance of various models of central air conditioners and air conditioning heat pumps with the applicable energy conservation standards. A cover letter describes the agency's actions to determine compliance prior to issuing the test notice.
On Aug. 23, 2007 DOE notified AeroSus of potential compliance concerns when the agency identified compliance violations involving through-the-wall central air conditioners and heat pumps. In 2008, DOE received notice that AeroSys heat pump model did not comply with DOE's energy conservation standard for a split-system. On Jan. 22, 2009, DOE sent a third leter to AeroSys requesting a cope of all test data underlying the claimed seasonal energy efficiency ration (SEER) ratings. On Feb. 24, 2009, the company exlpained that it did not have any test data supporting that its products complied with the standards but promised to provide DOE with the requisite data. In Spring 2009, after examining AeroSys data, DOE concluded that the AeroSys data are insufficient to confirm whether Aerosys products comply with the applicable energy performance standards and that AeroSys was not eligible to use an ARM to certify its products because the company did not obtain DOE approval under 10 CFR 430.24. In light of the above, DOE is exercising its authority to require AeroSys to provide sample units for testing and transmits this Test Notice to AeroSys, Inc., for the laboratory testing of each of the designated AeroSys products.
