Title 10 Code of Federal Regulations part 707 (10 CFR part 707), Workplace Substance Abuse Programs at DOE Sites, applies to DOE contractors and contains the drug testing requirements for their programs.10 CFR part 707.7 requires DOE contractors to develop a written drug testing program that is consistent with the requirements of the rule and the U.S. Department of Health and Human Services’ (HHS) Mandatory Guideline for Federal Workplace Drug Testing Programs (the Mandatory Guidelines).Both, the Mandatory Guidelines and 10 CFR part 707 require the use a custody and control form to document the security of the specimen from time of collection until receipt by the laboratory. 10 CFR part 707.16(e) provides for DOE contractors a list of the specific information that must be contained on the form, however a form was not provided. However, there is a custody and control form for Federal programs to comply with the Mandatory Guidelines.

Effective immediately, all DOE contractors must stop using the Federal custody and control form, as requested by HHS.DOE contractors must use in its place the Forensic Drug Testing Custody and Control Form (the look-a-like form) for their drug testing programs to comply with the requirements in 10 CFR part 707 and provide consistency in their drug testing programs. This form is currently available at HHS-certified laboratories.
