This Act sets general restrictions and permitting requirements on activities with the potential to disturb land and therefore contribute to erosion and sediment and alter stormwater runoff. Prior to engaging in such activities, persons must submit a stormwater management and sediment control plan to the Department of Health and Environmental Control or another appropriate implementing agency and receive a permit to proceed. Certain activities – such as emergency maintenance, underground placement of electricity and gas transmission lines, and activities conducted with alternative permits – are exempt from this provision and other portions of this Act.
