This law grants authority to the secretary of the Department of Environmental Protection to control and exercise regulatory jurisdiction over dams as indicated in the subsections of the law. This includes all inspections, permitting, fees, reviews and investigations necessary to carry out the law. Currently, only four hydroelectric dams exist in West Virginia. This law does not apply to dams that are owned, operated and maintained by the federal government.
