On April 18, 2002, Smith Brothers Gas Company (Smith) filed an Application for Exception with the Office of Hearings and Appeals (OHA) of the Department of Energy (DOE). Smith requests that it be relieved of the requirement to prepare and file the Energy Information Administration (EIA) form entitled "Resellers’/Retailers’ Monthly Petroleum Product Sales Report,” Form EIA-782B. As explained below, we have concluded that Smith has demonstrated that it is eligible for temporary exception relief.

On February 26, 2002, Fleischli Oil Company (Fleischli) filed an Application for Exception with the Office of Hearings and Appeals (OHA) of the Department of Energy (DOE). Fleischli requests that it be relieved of the requirement to prepare and file the Energy Information Administration (EIA) form entitled "Resellers’/Retailers’ Monthly Petroleum Product Sales Report,” Form EIA-782B. As explained below, we have concluded that Fleischli has not demonstrated that it should receive exception relief.

(North Side) of Milwaukee, Wisconsin filed an Application for Exception with the Office of Hearings and Appeals (OHA) of the Department of Energy (DOE). In its application, North Side requests that it be excused from filing the Energy Information Administration’s (EIA) form entitled "Resellers'/ Retailers' Monthly Petroleum Product Sales Report" (Form EIA-782B).

Jefferson City Oil requests that it be relieved of the requirement to prepare and file the Energy Information Administration's (EIA) form entitled "Resellers’/Retailers’ Monthly Petroleum Product Sales Report” (Form EIA-782(b)). As explained below, we have concluded that Jefferson City Oil has not demonstrated that it is entitled to exception relief.

In its application, Gas’n Shop requests that it be excused from filing the Energy Information Administration’s (EIA) form entitled "Resellers'/ Retailers' Monthly Petroleum Product Sales Report" (Form EIA-782B). For the reasons detailed below, we deny Gas’n Shop’s request for exception relief.
