PSH-13-0005 - In the Matter of Personnel Security Hearing

On May 16, 2013, an OHA Hearing Officer issued a decision in which he determined that the DOE should not restore an individual’s access authorization.  As security concerns under 10 CFR Part 710, a Local Security Office (LSO) cited the individual’s two arrests for Driving Under the Influence, his falsification of information regarding those arrests on three QNSPs, and his failure to report those arrests within the time period required.  The Hearing Officer found that (1) the individual had not resolved the concerns raised by a recent pattern of falsifications, particularly given the fact that he continued to deny the omission of significant information on his most recent QNSP; (2) the individual, who held a security clearance since 1984 and was well aware of the relevant requirements regarding reporting arrests, had not resolved the concerns raised by his failure to report his arrests; and (3) because the individual no longer presented a concern related to his alcohol use, the concerns raised by his two alcohol-related arrests had been resolved.
