OHA denied an Appeal filed by Preston P. Straub. Mr. Straub had requested all e-mails sent between certain dates, by a certain employee at the Argonne National Laboratory. The Chicago Office located two e-mails but declined to disclose them because it found that they are personal records, not agency records. Mr. Straub appealed, and OHA upheld the Chicago Office’s determination. OHA found that the e-mails are personal records because no agency employee had used or relied on them in conducting agency business. OHA Case No. FIA-12-0011.
