DOE prepared an EA and finding of no significant impact (FONSI) for cleanup and closure of DOE’s Energy Technology Engineering Center at the Santa Susana Field Laboratory in 2003. However, DOE’s FONSI for the subject EA was challenged, and the U.S. District Court for the Northern District of California’s May 2, 2007, ruling in the case Natural Resources Defense Council v. Department of Energy (Slip Op. 2007 WL 2349288 (N.D. Cal. Aug. 15, 2007)) held that DOE’s decision to issue a FONSI and conduct cleanup and closure on the basis of the EA was in violation of NEPA. The court enjoined DOE from transferring control of any portion of Santa Susana Field Laboratory Area IV until DOE completes an EIS and issues a Record of Decision pursuant to NEPA. DOE is preparing an EIS for remediation of Area IV and the Northern Buffer Zone at the Santa Susana Field Laboratory (see /nepa/eis-0402-santa-susana-field-laboratory-area-iv-california)
