SUBJECT:    Labor Compliance Advisor

SUMMARY:  Last July, President Obama issued Executive Order 13673, “Fair Pay and Safe Workplaces.”  The Order declares it to be Administration policy to take concrete actions to strengthen government contractor focus on compliance with labor laws, and to obtain more efficient and economic contract performance by contracting with companies that comply with those laws.  The Department relies critically upon contractor employees, their labor organizations, and their communities.  Ensuring compliance with labor laws is essential for the success of our missions.  EO 13673 requires each agency to designate a senior agency official to serve as a “Labor Compliance Advisor” (LCA).  The Secretary has designated the Assistant General Counsel for Labor and Pension Law (Labor AGC), currently Jean Stucky, as the Department of Energy's LCA. 

Jean will work with Department acquisition personnel, contractors, and the Department of Labor to improve contractor compliance with labor laws; however, many of the reporting and other requirements that will apply under the EO are already in place.  In implementing the EO, Jean will work closely with Senior Advisors to the Secretary David Foster and Natasha Campbell; the Office of General Counsel of National Nuclear Security Administration (NNSA), concerning any NNSA issues that arise; and with the Office of the Associate Under Secretary for Environment, Health, Safety and Security on all matters involving contractor employee safety and health.  Departmental field personnel should continue to communicate with Jean as usual through their GC site leads.
