Circuit dismissing the National Association of Regulatory Utiliy Commissioners' petition for review; Petioners requested that the Court issue three orders: (1) that the Secretary conduct an annual assessment under the Nuclear Waste Policy Act, (2) that the Nuclear Waste Fund fee be suspended pending completion of his annual assessment; and (3) that the Secretary suspend the NWF fee in light of the current status of DOE's waste disposal program; Court dismissed the first two claims as moot and the third claim as unripe.
