AeroSys: Proposed Penalty (2011-SCE-1624)

DOE alleged in an Amended Notice of Proposed Civil Penalty (NPCP) that AeroSys, Inc. failed to certify various basic models of space-constrained central air conditioners and air conditioning heat pumps as compliant with the applicable energy conservation standards.  DOE also alleged in the NPCP that AeroSys, Inc. manufactured and distributed in the U.S. noncompliant space-constrained central air conditioners and air conditioning heat pumps.  DOE regulations require a manufacturer (which includes importers) to submit reports certifying that its products have been tested and meet the applicable energy conservation standards.  Federal law subjects manufacturers and private labelers to civil penalties if those parties distribute in the U.S. products that do not meet applicable energy conservation standards.  This civil penalty notice advises the company of the potential penalties and DOE's administrative process, including the company's right to a hearing.
