DOE Petitions for NRC Review in Yucca Mountain Proceeding

The United States Department of Energy today filed with the Nuclear Regulatory Commission a petition requesting that the Commission review and reverse an order by the NRC’s Atomic Safety and Licensing Board which suspended, until it receives guidance from the Court of Appeals, consideration of the Department’s motion to withdraw its pending application to license the Yucca Mountain geologic repository. As today’s petition makes clear, however, the Department believes that “decision is misguided – turning on their heads core principles of administrative procedure.” The Department’s petition urges the Commission to review the Licensing Board’s order on an expedited basis, noting that the order, “unless promptly reversed, will deprive the Commission of the opportunity to provide, and the Court of Appeals the benefit of receiving, the Commission’s considered judgment on matters within its jurisdiction and expertise.”
