The Secretary of Energy signed Section 3116 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 basis of determination for the disposal of grouted residual waste in the tank systems at the Idaho Nuclear Technology and Engineering Center (INTEC) Tank Farm Facility (TFF) on November 19, 2006. Section 3116 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 authorizes the Secretary of Energy, in consultation with the Nuclear Regulatory Commission, to reclassify certain waste from reprocessing spent nuclear fuel from high-level waste to low-level waste if it meets the criteria set forth in Section 3116.
NRC issued their report on consultation, the Technical Evaluation Report (TER), on October 20, 2006, and it is available on the NRC electronic reading room at http://www.nrc.gov with an ADAMS accession number of ML062490108. Also, available via the NRC electronic reading room is the NRC Request for Additional Information (RAI) with the DOE responses to those RAIs. In addition to the NRC TER, several other documents support the information in the waste determination and DOE has included links to those documents in order to assist the reader. For example, a National Environmental Policy Act (NEPA) Record of Decision (ROD) was amended to reflect the Department’s decision to grout the cleaned TFF, and TFF system.
Basis for Section 3116 Determination for the Idaho Nuclear Technology and Engineering Center Tank Farm Facility at the Idaho National Laboratory - This 3116 Basis Document addresses the disposal of stabilized residuals in the TFF, and the TFF tank system, and disposal of the tanks, vaults, and associated piping and ancillary equipment at INTEC. The TFF tank system comprises the eleven 300,000-gal tanks, four 30,000-gal tanks, and the vaults, piping, structures, and ancillary equipment associated with these tanks.
Appendices for the Basis Document - INTEC Tank Farm Facility Closure Supporting Tables and Photographs - In support of the Tank Farm Facility (TFF) closure, inventory tables were generated for all tanks that have been cleaned up to this point.
Amended Record of Decision for the Idaho High-Level Waste (HLW) and Facilities Disposition Final Environmental Impact Statement - The U.S. Department of Energy (DOE) is amending its Record of Decision (ROD) published December 19, 2005 (70 Federal Register (FR) 75165), pursuant to the Idaho HIgh-Level Waste and Facilities Disposition Final Environmental Impact Statement (Final EIS) (DOE/EIS-0287. September 2002).
Federal Register Notice for the Waste Determination - Section 3116 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (NDAA) provides that certain waste from reprocessing spent nuclear fuel is not considered high-level waste (HLW) if the Secretary of Energy, in consultation with the Nuclear Regulatory Commission (NRC), determines that the waste meets the statutory criteria set forth in Section 3116(a).
