Comments on Supplemental Notice of Proposed Rulemaking for Alternative Efficiency Determination Methods and Test Procedures for Walk-In Coolers and Walk-In Freezers; Docket No. EERE-2011-BT-TP-0024

On behalf of our client, Bally Refrigerated Boxes, Inc. (“Bally” or “Company”), we are pleased to submit the enclosed comments on the February 20, 2014 supplemental notice of proposed rulemaking for walk-in cooler and walk-in freezer alternative efficiency determination methods and test procedures (79 Fed. Reg. 9818).

DOE ordered Whirlpool Corporation to pay a $5,329,800 civil penalty after finding Whirlpool had manufactured and distributed in commerce in the U.S. at least 26,649 units of basic model 8TAR81 noncompliant refrigerator-freezer.

Sanden Vendo America: Notice of Allowance (2014-SE-52002)

DOE issued a Notice of Allowance to Sanden Vendo America, Inc., allowing Sanden Vendo America to resume distribution of Class A refrigerated bottled or canned beverage vending machine model Vue30 (with 1128127 cassette refrigeration deck) after Sanden Vendo America provided documentation showing that it had modified the model to be in compliance with the applicable energy conservation standard.

DOE issued a Notice of Noncompliance Determination to Sanden Vendo America Inc. finding that Class A refrigerated bottled or canned beverage vending machine model Vue30 (with 1128127 cassette refrigeration deck) does not comport with the energy conservation standards.

DOE will not assert civil penalty authority over distributors for violation of the regional standard for central air conditioners.

Central Air Conditioner Enforcement Policy Statement

DOE will not seek civil penalties for violations of the regional standards applicable to central air conditioners that occur prior to July 1, 2016, provided that the violations are related to the distribution in commerce of units manufactured prior to January 1, 2015.
